Preventing Sewer Line from expanding into Rural/AG zoning communities
Not Possible. Cherokee County Water and Sewer (CCWSA) is an authority created by the state delegation in 1955. CCWSA is not part of the county government, and the commissioners have no authority to prevent the installation of sewer lines anywhere in the county.
Limiting all Multifamily (apartment) and R20 and lower dwellings to within city limits
Not Possible. This is a property rights issue. If the land use plan designates high-density and or Multifamily, the county cannot take that right away. If the commissioners were to agree to this, the landowner or developer could sue in court, and they would win.
Requiring future developments to meet the minimal lot size of the adjacent properties/zoning
Not Possible in all cases. Minimal lot sizes are based on the zoning category, and the zoning category is based on the character area designated for each parcel in the land use plan.
Altering Cherokee County Zoning Ordinance, Article 7.1, and Increase setbacks on all zoning by minimal of 5’ (long shot)
Why? Doing so would only increase the number of variance cases. The minimum setbacks for zoning categories have been in place for decades. There are approximately 6,000 lots that have already been approved, some of which were approved more than 30 years ago. Those lots have not yet been developed but they would be grandfathered with the setbacks in place when they were approved.
Expanding residential use of property with AG/rural zoning to lots of a minimum 2 acres
The AG/rural zoning already has a minimum lot size of 2 acres.
Requiring Commercial/Industrial zoning in non-city limits meet AG/rural stipulations
The county has development standards for all commercial and industrial zoning. The county commissioners can impose conditions with new re-zoning cases that might include design elements. Requiring commercial/industrial zoning to meet AG/rural stipulations is not possible or practical, especially for industrial uses.
